Delhi is a city of unpredictables and rumor mongers. Those who talkof rules and laws are mocked upon by all and sundry. People are highly intrusive. Respect of privacy is a strange idea. When I objected to one of my lawyer acquaintences who happened to call on me, to his pulling out my personal diary from the shelf and reading it, he flew into rage and said .” What’s wrong in it. You are a secretive man. You can read mine.” I said ” It’s like saying I fuck your wife you fuck mine”. I am not resorting to sweeping generalisation. This kind of attitude is a rule rather than exception. The city is deluded by small thinking, constricted, constipated educated & uneducated migrants mostly from the cow and buffaloe-belt. Substatially they try to monoplise its localities & tenements state, districts, village vize against each other & do mischief and criminal acts towards this end. The most vulnerables are the marginals and those who chose to stray away from their people. By and large there is a sort of etente among the larger segment like Biharis and UPs. Lesser ones are likely to be targetted by both if they are not living in big groups.

Yesterday as I was returning from work 9 pm I saw crowd & commotion ahead on Sir Syed Road, Jamianagar, One Sonu a laborer was stabbed by a gang of 5 ruffians despatched by his previous employer, a sub-contractor when he refused to accompany.

Uncle I told you they will do this to me and they do this to justify beating in public.” “Uncle help me. Please come”.

This was Mokit’s fourth master this year. The other three more or less did the same thing to him; made him work in in-human conditions followed by refusal to pay under one pretext or other, accusations and beatings.

Not getting alternative because of land-lord cartel.He’s been so much maligned in organized fashion. That sooner or later the muck would reach him some how even if he gets room elsewhere.

The landlord politician nexus runs through lower and middle level party politicians and ruffians that may include people around local councillors and M.L.A’s with their direct collusion or without.
The nexus is too over-reaching and powerful for any individual to escape.

The terror of the Ghost cat has been spreading farther and digging deeper since a fortnight now. Azans are being called from mosques at odd hours in night to ward off the devil. People are keeping vigil from roof tops, the whole night , passing sleepless nights.

There has been scores of attacks and hundreds of sighting.Yesterday the residents of Noor Basti beat up Shabana a dancer until she passed out. Somebody had spread the word that the black cat had entered her body.


The ghost cat reportedly attacked one Sharique of Telia Chowk yesterday another reported of seeing the ghost cat turning into a fox. Afzal of Arabic Madarsa was attacked inside the madarsa. The incidents is keeping mounting up.

The localities worst hit by the black shadow of devil and black cat are:Pandoli, Dhola Beri, Chalkana, Than Keri, Noor Basti, Choob Froshan, Mojhalla Mufti, Mohalla Ayi, nanota Nagal, Garhi Maluk, Shyam Puri Gopal Nagar e.t.c. There are 400 localities haunted by the ghost cat.

All attempts by authorities to dispel the terror of black cat and black shadow has come to nought. S.S.P Amit Chandra is fighting a losing battle in making the believers believe that phenomenon is nothing but hoax and a mischief. Faithfuls are swearing: it is real.

One Mr. Hashim a 6o year old hafiz ,and a long aquaintence reported to me that he had been to Saharanpur and he himself the black ghost attacking his acquaintence in full view of a score of on-lookers.

Previous Sunday. The boy was not more than 12 year old. He works in a road side canteen in a predominantly Muslim locality called Jamianagar in New Delhi consisting a population about of 2 lakh faithfuls- a prosperous place indeed.The muscular man rained blows with his fist on the boys head. The boy begged for mercy and whimpered and shrieked in pain. After the first round was over.The man started with his leg and knees. Twisting both the hands backwardsHe started hitting the boys chest with his knees. Then he dragged the boy to the cabin where they keep utensils and groceries. and slammed the door.After he came out of the cabin he had an iron grill in his hand which is used to pierce chunks of meat and roast them on of embers. There was complete silence inside. I presume the boy had lost conscious if not died. The owner of canteen his two sons and relatives and faithfuls eating there did not bother to pay any attention. People went about their chores as matter of factedly.The inquisitor was insisting that the boy must have spat on the canteen floor to which the boy denied.
There are a plethora of incidents -like these - and even worse -I come across day in and day out in Delhi.

It is six month now. I was walking towards Batla House bus-stand on my way to court. I was about 7 minute walk away from the bus stop when a small whirlpool of commotion erupted, about 20 yards or so ahead. People around the place suddenly standing in attention, their faces turned towards the focal point of incident, where a narrow street branched off towards Azim Dairy.



By the time I reached the spot a small circle of score of persons had converged around. I thought somebody had met with an accident.



A small boy dark skin, in an oversize shirt, and under-size pant, lay writhing, twisting and turning, caked in dust as if in a spasmodic attack of epilepsy.



After sometime they hauled him onto a wooden cot lying near by.



A little distance way a shopkeeper was narrating to a group of acquaintances as to what had happened.



"They were two of them, young fellows - stopped their bike over there". He pointed to a spot across the street.” Came over here - one of them held the boy another one rained blows on him- violently -very violently."


In the meanwhile the boy climbed down and sulked in his haunches, badly nauseating wanting to vomit. He changed places several times and finally settled near the cane juice shop dazed and listless. A young help splashed his face with water. The duo seemed to be in the know of each other.


After much gentle persuasion the young help gave in after much reluctance. The two youths who had wounded the boy were sound of the victim's previous employer, who would not pay him wages and would abuse and beat him all the time- would allow him only two hours sleep. The boy was only able to have his dinner around 1.00-2.00 A.M after fixing everything in the shop and would wake him up at the call of Azan.


As I left the place, the boy seemed to have recovered a little. He sat alone, lonely abandoned and marooned, gazing at something in air.

No race can prosper till it learns that there is as much dignity in tilling a field as in writing a poem.

As I descended the last stairs in its open cemented compound, facing the main gate, I was instinctively drawn towards the spot where a motley crowd of around 100 faithfuls had gathered around a person wearing loose blue shirt, red threads tied around his wrist. The man was terrified and was making weird gestures. He was the same man who distributed free Urdu News paper: ” Aftab-e hind” to the faithfuls every Friday. I too had collected the newspaper from him a number of timesin the past. “pickpocket”, “thief” such words bandied in the crowd. The cloud dissipated. The Mullaji – one of the maulanas and caretakers, a young man in his 30 had beckoned the poor man from inside the mosque compound. He refused his biddings. The Mullah had sprinted towards him. He made a bid to flee in panic. He was caught. As Mullaji grappled with him he laid himself flat on the sidewalk. The faithfuls coming out of the mosque after offering friday prayer lifted into the compound holding his hand and feet and without giving a second thoughtbeat him up. That was the end of the matter with him.”Your manner of beckoning him must have been intimidating that made him panicky, given he is a poor fellow and belonging to another community.” I said angrily.The Mullahji retorted : ” The same treatment would have been meted out to you if you had behaved like him”"I would have thrashed you if you had done so with me” I said.”you’d have known if it had only happened.” replied mullaji dirisively.Some lawyers from our court who had come to the mosque to offer Friday prayer approached the site and asked me to leave the place because they were afraid about my safety.As I was leaving the mosque the mullahji passed highly derogatory and provocative comments. They were sold by their Pakistani brethren to U.S military contractors, for USD 5000/- per head and are being held in dreaded Gitmo speciously as hard core terrorists for 6-7 years.

U.S administration with former US vice-president Dick Cheney and former defense secretary Donald Rumsfield fought off efforts by handful of military commanders who tried to address the issue.

There hasn’t been an iota of doubt with the US administration about these innocent inmates not being even remotely connected with anything that has to do with terrorism.

These inmates have been caged to serve as guinea pigs to give information about their region, society and for a mosaic of intelligence purposes.

The fact of innocence of large number of detainees affords them no protection against routine tortures and pain sessions.

The inmates are forced to undergo intense torture and stress to ensure that information given by them is correct and also to retrieve information lost in memory.

The stunning fact was revealed by select military commanders who have served at Gitmo and Mr. Lawrence Wilkerson, a republican who has served as chief of staff to secretary of state Collin Powell under Bush administration.

Pakistanis have been increasingly becoming compulsively and overly obsessed with cricket matches in Pakistan so much that it became a religion of religions, a spiritual exercise of sort. Faithful would prefer to miss or cut short their prayers to watch cricket matches. Even children and those who wouldn’t get hang of anything of the sport would die to be in the stadium or watch the matches on T.V. just to imbibe the electrifying atmosphere. Religious meetings would be re-scheduled taking into the consideration the cricket matches. The attack was inevitable by the extremists. I have always wondered as to why the extremists spared the sport on the face of such a situation.

Supreme Court Judge Mocks Human Rights activists


The Honble Supreme Court of India judge shri Ajit Pasayat branded human rights activists as animal rights activists and charged them as supporters of terrorists, while addressing a Conference on terrorism, organized by Indian law Institute in Delhi on 27.02.2009.

Rules of law, natural justice, equity, good conscience to a wise purpose deem an accused innocent until he is pronounced guilty. Do human rights activists come against convictions on the street?

Do they question process and rule of law and authority ?They do raise their voices against abuse of law and outrage of basic human rights of hapless victims.- a duty also cast upon judges who are moreover under oath as such.
By the same logic the legal procedures of review, revision, appeal, protest and curative petitions should be declared unlawful and anti-national and even the advocates who take the cases of purported offenders.

It is in-correct to see human rights groups solely in communal and caste perspectives, while there may be pseudo-human rights groups and the ones floated by criminals and racketeers, that asides they are the only hope for the most crippled and vulnerable segments of the society against persecution, oppression and exploitation by the state agencies and powerful private individuals and groups, in a country where culture of lie and might is right and crowd power dominate every segment of the society.

The remark of the honble judge came as no surprise to me. Most of our academics, professionals and experts are nothing more than mechanics. The development of their faculties is lopsided. They are not brought up on values and they are hardly inculcated love for truth and justice by their parents and teachers. It is all about becoming big men someday.

We have lots of people at the helm, judiciary no exception, that they are born with silver spoons in their mouth. They live in ivory towers and are as much foreigners, alien to the harsh realities of Indian life among others.

In fact the country needs more safe guards against state terror and subtle and crass forms of ubiquitous forms terrorism being spearheaded by fascist forces in which common man is involved

Isn’t this a fact that the disputed land was forcibly and illegally occupied in 1948 and the sons of the soil forced to abandon their hearth, homes and chattels and belongings and forced out of their homes to be refugees for the rest of the time.

Mr. Mark Doesn’t international law permits arm resistance against occupying forces? and why don’t your restore the property to their rightful owners.

Can’t we ask the same question from You, the west and the U.S “against who and for what?

Lawyers unsuccessfully oppose new amendment.


The lawyers from other four courts of Delhi i.e. Kakardoma, Tishazari, Rohni and Dwarka came in a motorcade of 40 cars. Mr. Kola shouted from a mini-truck on the microphone asking us to come out. We were assemble in the lawn at gate no. 2 listening to speeches of senior lawyers about the demerits of the new amendment to section 40 and section 314 of Indian Criminal Procedure Code.

We went out. I climbed onto one of the mini-truck, where the president of our Bar and other office bearers were also present.

The motorcade made a round of India gate slowly shouting slogans against the government’s anti-people policies and the amendments. Nearly in 45 minutes we reached back our court where we were given again dozes of lectures and of course refreshments and tea.

They said that amendment was made thoughtlessly to protect the politicians who are increasingly coming under the scanner for a plethora of crime and corruptions.

The police have been given the powers which hitherto were exercised by the judges –Now the pit is not mandatory for police to make arrest in offences attracting punishment unto seven years. It is upto the police officer whether he arrests or not. There was wisdom behind giving the powers to judges of judicial scrutiny of the action of the police. It was a part of perfect check and balance system.

They said that aping west would be counterproductive because the caliber and character of Indian Police is known to everybody. It is a license to extortion and also to save the politicians from going behind the bars as they are increasingly coming under the scanner for range of heinous offences and corruption

Muslim Meet claims start of political struggle of Indian Muslims


They held the public meeting at Ramleela Ground New Delhi, which is not more than 15 minutes walk from New Delhi Railway Station.

I got down at Khuni darwaza (Bloody Gate) Delhi Gate and walked 20 minutes to reach Turkaman Gate where they are holding the historical landmark Muslim conference under the banner of Milli Council - Delhi is dotted with Gates i.e huge structures of Sultanate and Mughal eras which serve as land marks - where Ramleela Ground is situated, a ten minute walk from New Delhi Railway Station and half an hour walk away from the historical Jama Mosques built by Mughal emperor Shahjahan, through cluttered, meandering criss-crossing streets and lanes competing each other in filth and congestion , consisting of pedestrians, cycle rickshaws, carts, bikes and encroachment on streets flanked by dirty restaurants, provision shops, beetle shops and workshops with noises of indescribable varieties hitting the eardrums. It may probably take days to cover the gigantic ghetto of Muslim localities of the walled city. The sprawling expanse of Ramleela Ground stands in sharp contrast.

The weather here is extremely pleasant -bright sunny, cool and windy - for the last few days.

The stage covered almost half of the width of the enclosed field with hundreds of special invitees
squeezing and squatting chock a jowl, most of them in shining white clothes worn for the occasion.

When I reached the ground Mr. Ahmedi the retired chief justice of Supreme Court of India was was on the mike ; ‘ The man who has one yard of land would not think of snatching from a man with 99 yards but the later would always like to make his 99, a hundred” He sermonised intermittently thanking the chairman Dr. Manzoor for honouring him. “Assert your right” he said. an not to encroach upon the right of other citizens because that is the real problem here in India Muslims all the more.
When I left one Mr.. Raje a professor of management at Jodhpur University in the state of Rajashthan in India was reading out the charter of demands that sounded like a nursery rhyme-reservations and commissions- a 10% in every thing.

Manzoor the chairman of Milli Council and a nearly a half dozen of them on the stage, are seen as rabid semitic and men of small thinking.

Perhaps they had expected a big attendance and had spread cheap green and red venyl carpets- half of the width of the ground and on the spare area posse of policemen lazied, basked in the sweet sunlight and chatted among themselves in groups.
This one was also was touted as a big historically landmark socio-political event for the Indian Muslims. The crowd almost cent percent consisted of Muslims brought inn chatterer buses from the different Muslim loclities of Delhi and state of Uttarpradesh. There were few people who came on their own.If Muslim from the adjoining walled city had turned up the ground would have spilled over for that matter there was no parking problem.

The un-applauding crowd listened with moronic detachment to the speeches of stalwarts many of whom have climbed the ladder of Muslim leadership by sheer force of Saudi Black Dollar and many among them are seen by independent Muslims as charlatans and Shylock’s.

One of the star stalwart speakers Mr Owasisi a cleric asked Muslims to become like bees around the queen and follow unquestionably to the dictates of Milli Council office bearers.

I left the meeting bored and un-lightened rather full of questions and doubts.

Jamiatul Ulema Council demonstrates at Jantar Manntar Delhi


Jamiatul Ulema Council held a demonstration at Jantar Mantar, New Delhi, India.

The protest demonstration was atleast 15000 Muslims from Azamgarh, State of Uttar Pradesh and claimed that the occasion of martyrdom of the two youths is a beginning of a historical political struggle.

I felt like getting a hang of this historical meeting. They protested against what they said fake encounters of two Muslim students hailing from the state, at Batla House New Delhi.
There were a score of Islamic scholars, intellectuals and academics on the stage.

The Council is perhaps planning to contest the coming Parliamentary elections.

They condemned framing of innocent Muslims specially educated ones on terrorism related charges.

I was on my way to court when I changed my plans and decided to attend the meeting.

Today I am spent.Remained there from 11AM in the morning to 4 PM in the evening. Tommorrow I’ll write in detail. .

Jamaiatul Ulma-e-Hind, a top Muslim cleric body takes up his case. In reply to SCI’s Notice the Central Government said that on the basis of findings of Army authorities it appeared from the Islamic literatures, treatises and holy books that growing beards is preferable as a tradition of Prophet but not obligatory. Now it was the turn of the plaintiff to file a rejoinder in reply and they would.Soon after the reply filed by the Central Government, the JUH started raising a hue and cry, holding audiences with media specially the communal Urdu vernacular press, Muslim constituents and organizations blaming the government of interference in religious matters stating that “it is not for the government to decide whether it is obligatory for a Muslim to grow beards or not ,it is not for government to classify and categorize Islamic issues” said Neyaz Ahmed Farooqui among others, addressing a large gathering at its Headquarters at I.T.O, New Delhi, on 24 January 2009.

This being a series of such meetings held this month. Raising the bogey of threat to Muslim Identity, the scholars called upon Muslims to guard their identity and for that matter their right to have beard.The acts of JUH in stretching a technical legal issue involving, a single person in one of the government departments and converting it into a specious identity crisis of 20 million Indian Muslims, for that matter Islam is in danger syndrome- the occasion, timing, manner and extent, twisting of facts and circumstances and stirring of communal passions- points to their intellectual bankruptcy and unholy objectives.

Indian lawyers begins unrest.

The Bar Associations of North Indian states compromising of states of Uttar Pradesh, Uttaranchal, Himachal Pradesh, Punjab, Haryana, Jammu and Kashmir and Delhi have announced complete strike on January.19. 2009.

This is first co-coordinated effort by Bar Associations of India to oppose the Bill which seeks to amend section 41 and section 309 of Criminal Procedure Code of India.

Different bar Associations in India has been resorting to strikes, quite now and then for the last couple of months.

Circulars and Bills issued on respective Letter heads of Bar Associations, warns of strict action if any lawyer were to be found violating the call of strike.

The lawyers of whole of India would again go on strike on Feb, 3.2009.They have announced nation-wide demonstration and protest marches and street corner meeting against the Bill on 18 Feb, 2009.

Mr. Alit Make, the Urban Development Minister, who once belonged to legal fraternity, in an interface with lawyers held at Partial House courts Delhi on 15Jan 2009 vowed to take up the issue with his colleagues in the Cabinet, the prime minister, and the president of India against the proposed Bill.

The Bill takes away certain categories of offences under sections 41 and 309 Criminal Procedure Code of India, which gives mandatory arrest power to the police.

Among the grouses of the lawyers is that the law if enacted will eat into their work substantially reducing their income. A sizeable income of the lawyers is generated by Bail related works.

According to the proposed amendment it would not be mandatory for the police to arrest the offenders involved in theft, assault, dowry related cases, chain snatching, and child abduction, pick-pocketing, stabbing, infringement of copyright and trade marks.

Human rights groups say that sweeping power of arrest in a poor country like India where 800million people some how manage to earn Rs. 20/- per day, the power punishes the delinquents and their dependents too harshly.

Thousands languish behind bars or tears an ends even after courts have ordered their release, because they are not able to arrange the security which usually Rs. ten thousand equivalent to 200 U.S dollar.

Lawyers say this will increase the incidence of crime and aggravate security related problems

The present mid-east crisis stems not from the Hamas firing rockets at illegal para-military settlements in southern Israel but Israel’s selective killing of Hamas leaders and blockade of 15 lakh Palestinians living in world’s worst densely populated concentration camps , during the period truce was in force, leading to serious humanitarian crisis, on the face of criminal silence and in action of the world community. The crisis could have been averted if they had somehow stopped Israe’ls even handedness.

Hamas is a legitimately elected government with rag a tag of security force . Suppose if the humanitarian crisis, at the same scale, was created in Israel, with Hamas systematically eliminating extremist Jewish leaders wouldn’t Israel have sent missiles and bombs into Gaza.

Simply because Hamas is Islamic, and leading a dynamic struggle against Israel’s subjugation including use of force does not make it terrorist group.

I had said: “unless you take out the bones from each others’ throat, they’d continue to scratch each others’ face.” I thought it was Hamas. I was naïve. I thought that I had scored a point. I posted a question “Has Hamas asked for the Israeli bombings?”. My question set off fiery debates in various communities in the face book and elsewhere. I found myself ending up on the side of Israel invariably.

 

 

I learnt that bones in the throats of Arab, Palestinians on one side and Israel on the other side was located by the Arab League a decade back. And they had offered to take out the bone painlessly. They had offered Israel to return to it’s pre1965 position in exchange of it’s recognition by the entire Arab world.

In this age you cannot conquer land, keep it , subjugate people and assume the right to dictate and define the terms and forms of resistance the subjugated can wage.To top Israel has been resettling its Para military personnel in the occupied land with impunity to claim it permanently. Another term of the said offer was the sharing of control and management of Jerusalem, among the Arabs, Christians and Jews.

Israel may decimate one Hamas yet another more powerful and clever would be born.

Israel seems to be the only nation that plays God after U.S.

We are all Hamas,” screamed a scrawny Mauritanian, repeatedly, as he determinedly drew his face closer to a TV camera.

Behind him, thousands more tunefully chanted similar words, chants that were heard in different Arabic dialects, in fact in many different languages all across the globe. Yet, Israel, somehow is claiming victory in the media war, which it calculatedly unleashed weeks before its most violent attack on Gaza yet. Thousands have been reportedly killed and wounded in little more than a week, starting December 27, in the tiny stretch of land (roughly 140 square miles), yet densely populated Gaza Strip of 1.5 million people.

“Whenever Israel is bombing, it is hard to explain our position to the world,” said Avi Pazner, former Israeli ambassador to Italy and France, and “one of the officials drafted in to present Israel’s case to the world media,” according to the Jewish Chronicle. “But at least this time everything was ready and in place.”

“Fewer military officers; more women; tightly controlled messages; and ministers kept on a short leash. This was Israel’s new media game-plan in Operation Cast Lead,” the newspaper reported. It’s always difficult to fathom Israel’s giddiness and sense of triumph as defenceless civilians are pulverised by mostly US-supplied warplanes and bombs.

Even if one chooses to empathise with Israel’s dodgy claim, parroted endlessly by the Bush administration, that the Israeli army is in a state of self-defence, one can never fully grasp the wisdom of its military tactics.

“Fatalities in Gaza are already over 400 and injuries close to 2000 so far as is known. Total Palestinian civilian casualties are 400 times greater than the casualties incurred by Israelis,” wrote three-time presidential candidate Ralph Nader in an open letter to President Bush, five days into the Israeli onslaught. Nearly one week after the devastating air strikes, Israel unleashed a ground offensive, which is pushing the casualty figures to unprecedented heights, made mostly of civilian victims.

Much of Israel’s war machine is financed, manufactured and supplied by the United States. US financial and military generosity has served as the backbone of all of Israel’s wars against its neighbours, including the Palestinians. In Israel’s war against Lebanon in the summer of 2006, lest it runs out, the US rushed ‘emergency’ military supplies, including cluster bombs to the Israeli army, allowing the latter to ensure the demise of its arch enemy: thousands of dead and wounded Lebanese civilians.

In the ongoing war against Gaza, neither the US’ “dedication to the security of Israel”, nor Israel’s dedication to inflicting maximum harm on civilians have been in any way altered. While Bush brazenly chastised Hamas and the Palestinians for the death wrought on them by Israel, President-elect Barack Obama had absolutely nothing to say.

“The scale of bloodshed in Gaza over five days is the same as if almost 2,000 Israelis had been killed and 9,000 wounded in the same period. Imagine the consequences for Israel in such an event,” wrote author and former BBC correspondent Deepak Tripathi. Would Obama find the staggering number worthy of cutting short his Hawaii vacation, even for a brief comment, if the tables were turned? Candidate of change, he said.

But Israel is winning the media war, reports Israel; a peculiar claim by any standards. If the reference is made to a “victory’ that helped win over mainstream US media, one has to wonder if the corporate media has ever expressed any sympathy for Hamas, or any resisting Palestinian faction, be it secular, socialist or Islamist?

The opposite has always been true. Any violent Palestinian response to the Israeli occupation and its inherent violence has been dubbed “terrorist” for decades, even if Palestinians were targeting Israeli soldiers or paramilitary settlers. Aside from allowing a ‘moderate’ Palestinian commentator an occasional limited space to write a watered down op-ed, now and then – which serves as a feel good moment that demonstrates the ‘objectivity’ of US media - the pro-Israel mantra has defined every major American newspaper in every city in every state. That requires a separate discussion, but the persistent question remains: what is Israel winning exactly?

More Israeli women are taking Israel’s case to the media, according to reports. The strategy is both sexist and underhanded. Following the Lebanon war, Israeli bikini models flooded US men’s magazines exhibiting their barely covered bodies. Former Miss Israel, model Gal Gadot defended her nude photos, promoted partly by the Israeli consulate in New York as her attempt to help “improve Israel’s war-torn image,” reported the New York Post in June, 2007. Now as Israeli bombs are lightening the sky of Gaza, similar tactics are underway, in Maxim and other magazines.

Kadima leader and Foreign Minister Tzipi Livni took its message to YouTube, conveying the same redundant but “tightly controlled” misinformation, that attempts to explain why imprisoning, starving then senselessly bombing 1.5 million Palestinian Muslims and Christians is good for world peace, for democracy, for security, 
for the future of the region and the world.

But the fact is, Israel never won the media war in the US for, frankly, there was never one to begin with. Yet somehow, millions of people around the world managed to read through the filters, the propaganda, the perplexing logic, the Maxim cover pages, and took to the streets in a collective act of passion and dismay, without billion-dollar media crafters “tightly controlling” their every move, scripting their chants or directing their hoarse voices: We are all Palestinians and “with our souls, with our blood, we will die for you Gaza.”

What has Israel won exactly, aside from the haunting images of young Palestinians, mutilated, some silent and others screaming? This is no victory, but a brief illusion of one. As for the long-term repercussions, that is a completely different story. Israeli bombs over Lebanon in 1982 gave rise to Hezbollah, and its war of 2006 turned a small, resisting militant movement into a major power broker that will certainly help shape the future of Lebanon. Israel is now doing the same in Gaza. A victory, indeed.

Europeans have been dumping nuclear waste in Somalia’s seas and looting seafood. This is the context in which the ‘pirates’ have emerged, argues JOHANN HARI

Who imagined that in 2009, the world’s governments would be declaring a new War on Pirates? As you read this, the British Royal Navy, backed by the ships of more than two dozen nations, from the US to China, is sailing into Somalian waters to take on men we still picture as parrot-on-the-shoulder pantomime villains. They will soon be fighting Somalian ships and even chasing the pirates onto land, into one of the most broken countries on earth.
But behind the arrr-me-hearties oddness of this tale, there is an untold scandal. The people governments are labelling as “one of the great menaces of our times” have an extraordinary story to tell, and some justice on their side.
Pirates have never been quite who we think they are. In the “golden age of piracy”, from 1650 to 1730, the idea of the pirate as the senseless, savage Bluebeard that lingers today was created by the British government in a great propaganda heave. Many ordinary people believed it was false: pirates were often saved from the gallows by supportive crowds. Why? What did they see that we can’t? In his book Villains Of All Nations, historian Marcus Rediker pores through the evidence.
If you became a merchant or navy sailor then, plucked from the docks of London’s East End, young and hungry, you ended up in a floating wooden Hell. You worked all hours on a cramped, half-starved ship, and if you slacked off, the all-powerful captain would whip you with the Cat O’ Nine Tails. If you slacked often, you could be thrown overboard. And at the end of months or years of this, you were often cheated of your wages.
Pirates were the first people to rebel against this world. They mutinied, and created a different way of working on the seas. Once they had a ship, the pirates elected their captains, and made all their decisions collectively, without torture. They shared their bounty out in what Rediker calls “one of the most egalitarian plans for the disposition of resources to be found anywhere in the eighteenth century”.
They even took in escaped African slaves and lived with them as equals. The pirates showed “quite clearly, and subversively, that ships did not have to be run in the brutal and oppressive ways of the merchant service and the Royal Navy.” This is why they were romantic heroes, despite being unproductive thieves.
The words of one pirate from that lost age, a young British man called William Scott, should echo into this new age of piracy. Just before he was hanged in Charleston, South Carolina, he said: “What I did was to keep me from perishing. I was forced to go a-pirating to live.”
In 1991, the government of Somalia collapsed. Its nine million people have been teetering on starvation ever since, and the ugliest forces in the Western world have seen this as a great opportunity to steal the country’s food supply and dump nuclear waste in their seas.
Yes: nuclear waste. As soon as the government was gone, mysterious European ships started appearing off the coast of Somalia, dumping vast barrels into the ocean. The coastal population began to sicken. At first they suffered strange rashes, nausea and malformed babies. Then, after the 2005 tsunami, hundreds of the dumped and leaking barrels washed up on shore. People began to suffer from radiation sickness, and more than 300 died.
Ahmedou Ould-Abdallah, the UN envoy to Somalia, tells me: “Somebody is dumping nuclear material here. There is also lead, and heavy metals such as cadmium and mercury, you name it.” Much of it can be traced back to European hospitals and factories, who seem to be passing it on to the Italian mafia to “dispose” of cheaply. When I asked Mr Ould-Abdallah what European governments were doing about it, he said with a sigh: “Nothing. There has been no clean-up, no compensation, and no prevention.”
At the same time, other European ships have been looting Somalia’s seas of their greatest resource: seafood. Europeans have destroyed their own fish stocks by over-exploitation, and have now moved on to Somalia’s. More than $300 million worth of tuna, shrimp, and lobster are being stolen every year by illegal trawlers. The local fishermen are now starving.
Mohammed Hussein, a fisherman in the town of Marka, 100 km south of Mogadishu, told Reuters: “If nothing is done, there soon won’t be much fish left in our coastal waters.”

The Times of India Sunday edition 4.01.2009 gave a prominent place to the author’s write-up.

Mr. Hanif tries to defend the indefensible .He puts words into our mouth, using those words as premises builds his arguments supported by baseless information of bricks of superficial and facts devoid of figures.

Hanif says “the alliance between ISI and Jehadis was a marriage of convenience which has broken down irrevocably.

No where in his write up he has used the word “terrorism or “terrorist”- a naked gloss over indeed. Contrast it with our position. We are categorical and specific.

We say more people have been killed by terrorist in our country than the two wars with Pakistan, the latest attack taking place in Mumbai in which around 600 civilians were killed on 26.11.208. The Pakistani terrorist belonging to Lashkar e Tayiba shot dead 600 civilians at Railway station 3 five star hotels and Jewish Kabad.

We gave Pakistan names of specific terror groups and individuals and locations of training camps in Pakistan.

In the first place how can a state have a marriage of convenience with terrorist organizations which is its own subjects, under its nose and territory? How can they exist in the first place nay to be allowed unless it is created, controlled and used?

Hanif says how much training you need to shoot civilians at random and blow yourself up.

The defense experts around the world opined that the terrorist operation in Mumbai, India that took place on 26.11.08 beats 9/11 in sophistication and complexities.

This apart you need a big infra-structre to sustain the terrorism industry and lot of training enabling the terrorists to carry out their missions across the borders with precision.

Hanif says that more soldiers have been killed by jehadis in Pakistan than the two wars with India and that Indian P.M can have the same degree of control that once Musharraf had in Pakistan if he became one like him and that the Nukes in Pakistan are no more in danger as nukes in India and Israel are from their extremists.

For a celebrated author like Hanif it was no difficult for him to get a figure as to how many soldiers have been killed jehadis in Pakistan.

Institutions in India are well entrenched with deep roots and well fortified. The Indian authorities are in much more control of things that any dictator in the third world can dream of.

Admittedly even after breaking down of alliance between terrorists and Pakistani establishment the ever mushrooming jihad groups could not be smashed and contained and their ability to strike qt will in the sub-continent and their growing mass support shows that there is a danger of nukes falling in the hands if not in immediate future.
The scenario in India and Israel vis-à-vis Pakistan is diametrically opposite.

Pakistan is admitting it inability although speciously to stop terrorist from carry out strikes across its borders and it neither will.

No option is left with India but to act decisively or abandon its responsibility to protect its citizens.

Escape goats for cheats


One day one Beg a regular client of Mr. Medi involved in scores of cheque bounce cases under Section 138 of Negotiable Instrument Act and cheating cases asked Sheel to sign a bunch of papers consisting of reply and vakalatnama etc in deliberate absence of Mr. Medi. He informed Sheel that Mr. Medi had asked Sheel to sign the papers and identify the client before the oath commissioner and submit the papers to the court. Sheel was totally ignorant of the contents and was not given any time to go through it. Such situation of specious urgency is deliberately created.

The clerk escapes unhurt


Mr Medi kept a clerk -Mr Gupta just two days after I got associated with him. Mr. Gupta was around 50 years old. The thumb and index finger of his right hand was amputated by a cutting machine. He used to be a book binder earlier. Mr Medi retained him for one month and at the end of the month one day he created such a scene, He started throwing tantrums saying that somebody had tried to break the lock of his drawyer -hinting at Gupta. Now we are going to break his hands and feet”. Lawyers around started paying attention to the racket. A writ to cone and fleece the poor


A writ application under section 482 CrPc for quashing of First Information Report filed on behalf of dumper driver involved in crushing of four T.V stars at Lodhi Road was dismissed by the Hoble Delhi High Court as premature and baseless. Mr Medi told the father of the accused that the writ was rejected because of incorrect translation of F.I.R done by Sheel for which the party was supposed to pay Sheel Rs. 150. The client had paid Rs. 25000/- to Mr. Medi a cut of which was supposed to go to a reporter of a Hindi newspaper who had roped in the client and borught it to Mr. Medi. Behind the back of client Mr. Medi would yell before visitors and acquaintances that that the party had’nt paid him a dime. However the father of the accused did not buy Medi’s cannard and paid Sheel Rs.150/-and shamed Mr. Medi.

The writ in question was destined to be rejected as it did not fulfilled the criteria laid by the Hon’ble High Court which says that the wrong should be apparent and patently on the face of record, else the first question the High Court raises is that whether charge has been framed by the subordinate court, the subordinate court may discharge the accused if it is merited.

Endless bluffs


One day he asked Sheel to take a long date from court no 3 and asked Sheel to get exemption from personal appearance and take a longer date as possible, for one Mr Meta an accused in a cheque bounce case. “He told Sheel That Mr. Meta would pay him Rs. 300 for that and that he could keep all the money. Recently the Delhi High Court has banned further construction and encroachments.

Few months back additional Station House Officer and other police officials of New Friends Colony Police Station was pulled out from the police post and beaten up with iron rods in cold blood which resulted in multiple injuries and fractures of skulls and back bones of the police officials. As a prelude a rumor was spread that some constables have desecrated Holy Quran at Zakir Nagar market. Trained goons did the job in cold blood the reason being that the Additional SHO would not allow banned construction under strict High Court Orders.
All the conspirators have gone Scott free.

A tenant is expected not to return before 9 in the nightnoot cook anything in the house.The rooms usually have breaches on the walls, doors, or windows so that they could see inside anytime.

She shook her head left and right. He answered back. She repeated the act half a dozen times so did he. She rushed towards him in quick steps and nudged him with her nose barely touching his body what appeared to be a gentle attempted caress. She stood motionless frozen for a moment. She lifted her right leg in a bend of 90 degree and then straightened it. She repeated it with her left leg. Left-right, left-right over and over and again, her legs hovering and sliding up and down his body. He lay there on sand filled rectangular bed where the title holder is yet to construct his house. She walked straight up to the desolate street , took a turn towards the north , went ahead a few meters , stopped and turned her face back gazing at him , took a few more steps ahead in a jiffy . She was there on the sand bed standing away form him this time - her body cut half into mild yellow and greyish white by the morning sunlight and the red brick house in the north, watching intently at him. Yamuna River gobbled up by illegal settlers. So the emaciated and sickly creatures have to fend for themselves and they roam the streets and lanes trying to find food in garbage heaps which rarely have any thing worth eating for them and everywhere in this grassless and treeless waste.
The calf as if propelled by a shock raised itself on his fours and pranced towards her mother’s tit. After fondling with her tits few times, he broke away and stood a little distance away. The truth had now unfolded itself bare perhaps. Perhaps the calf would not have any more of the bluffs. Mother’s milk had run dry.

The Gestapo of Delhi's urban poor rickshawpullers

Being a rickshaw puller is not every man's cup of tea. More than endurance and stamina you need a super human grit and a thick skin to put up with the daily dozes of revolting muscles and bones, thrashings, abuses and sometimes wounds that take long to heal. at the hands of beings whom the father of our nation once called bullies.

The round the corner tea shack is the only shop that opens at 6A.M. - a rickshaw pullers only haunt. People here wake up an hour and half later than the rest of Delhi. The missing of morning newspaper, ever since I shifted here 4 months back is more than offsetted by the conversations, gossips - that to me is a thresh hold to a new world - that takes place among the rickshawpullers, laborers and in this small hut and which has graced me with moral duty to highlight there plight and take up their cause under the aegis of our newly formed Organisation: " movement for Economic Democracy". I share with you excerpts of their conversation adverbtim.

I was in the hut, 5 minutes walk away from my one room tenement at Okhla- predominantly Muslim locality close to now dried up and wasted river Yamuna.
" Brought medicines yesterday. Heaviness in the head and nausea go away"
said Rafi the rickshaw puller, emaciated , in his 20's who has taken to the job 6 month back.
"Nothing left in Delhi - prices are soaring - better labour in fields of others in the village"
Said Bholoo a middle aged one.
"But he has 3 sisters to marry " said the tea vendor pointing towards Rafi " I asked him, six days ago to go to medical( All India Institute of Medical Sciences) W hat does this quack know what has gone inside. They do free x-ray over there ."
"Why didn't you whirl your cycle chain at them - I would have done it if I had been in your place" said another in sandow and a piece of cloth wound around his lower torso.
" Easier said than done" said the tea vendor "Who cares about us - not even the police - we are always wrong always a suspect (of delinquency) - on street, in markert, in mosques, in shrines- one day they checked the bag of loharoo while he was coming out of mosque to ensure that he was not carrying away the sandals of the faithfuls".

Hakim tried to say full throated to come over his gruffly voice "let them ban rickshaw in Zakirnagar the buttock of residents would go burst" Zakir Chacha has started selling off his rickshaws lest he'd have to sell them off by weight. The owner might also ask him to vacate the (vacant) plot any moment - election is drawing near - building activities have started here and there - the police was saying that MLA sahib has instructed the Sahab (Station House Officer of Police Station) to go soft on illegal constructions and encroachments- there is no spare rickshaw available on rent in Zakirnagar - The poor fellows are without work for a week. Elsewhere they won’t rent rickshaw to a stranger. They ask for reference. Who would this alien city (most of the rickshaw pullers hails from the remote villages and districts in Bihar West Bengal etc. They would rent rickshaw only f half a dozen of rickshaw pullers pullers already there testify that the incumbent is already known to him.

After a week I chanced upon Rafi in the same hut and enquired about his health and what had happened that day that led to his illness.
" There is no more nausea but the heaviness in head wont go away. There is a sort of tiredness in the eyes all the time - piercing pain quite now and then is agonizing the chest - all the time I feel afraid while on street with my rickshaw."
"What had happened “I enquired.”?

"I was waiting for the lady near lane No5- she had gone inside to fetch fare of Rs. 5/- she was short of change- A shopkeeper on the other side of the road started abusing me and ordered me to move - upon my saying that I am waiting for the fare, Hell broke loose-- He pounced upon me - rained kicks and blows all over me and then held my neck in his powerful grip 0 I began to suffocate- my position was like the hen in the grip of round the corner butcher - I was passing out - lay on the road - then somebody threw a bucket of water on me. I regained control of my body and mind. Somebody asked me to do BELDARI (laboring in construction of houses and buildings in the area. There are absolutely no safe guards. You'd find workers working in hair raising precarious conditions... Fatal accidents are common. These workers are not entitled to get compensation under any law. Those who survive have no option but to beg I'd come to this segment later.

“Only 15 days back a 3000 liter water tank fell on kafeel- they were five of them- they were raising the tank to the fifth floor. The two below managed to escape unhurt. He was recovering well with steel rods inserted in his back, hands and legs. Doctors had declared him out of danger. His family was told in the morning when they went to the hospital to bring him home that he was dead.
After two days they received his postmortem body. He was only 18. He lived next to Al-taqwa mosque at jogabai extension - supported his father to manage 6 dependent heads".contd….

Adhaan and men of clay

It is four months since I took up residence here at Jogabai Extension, an out growth of the predominantly Muslim locality known as Zakirnagar .The outgrowth is said to be an unlawful encroachment on the dried up bed of river Yamuna. I stay in the ground floor, in a small room, of a two storey, un-plastered house built on fifty square feet of sand filled land. One of the doors of my room opens on traffic less street which is used by pedestrian cyclists and occasionally two wheelers as of now.

Ever since my stay here when ever I woke up any time in the night I would be met by a disturbing and terrific tradling, squeaking sound of a bullock cart zooming past till the muezzins’ call of adhan went up at the crack of dawn , and beyond. The rhythmic whack of baton in perfect rhyme with mad raining of hooves squeaks and treadles... The impressions would evaporate no sooner they would get registered in my mind matter of factedly. .

Today I went in a different direction for my morning cup of tea in the open and walk and for that matter I ventured further north towards the Yamuna on my return journey. Was it an alive being with the senses of thirst, hunger, pain? Its mouth open in perfect 30 degree angle, bisected by a straight nearly cylindrical muddy tongue struggling to shoot out from the base. The mouth and tongue seemed locked still in a picture frame out of thirst, hunger, pain or constriction it is difficult for me to say.


The bruised black open mouthed buffalo-bull answering intermittent raining of batons with spurts of vertical jumps and then resuming the run. The cart was the size of a mini-truck laden with a mountain of grey sand loaded from the Yamuna bank. It was 7.30 in the morning. Alas! One more prayer had gone up from the minaret’s, dotting the sky line. “For Allah’s sake stop this cruelty”. It was 120 days and 120 nights the poor creature had been undergoing the merciless travails and how many more days lay ahead of him to be perfect clay

I sat brooding on the side walk with a Rs.3/- pen and a piece of soiled paper: “Ah Allah has not enabled me to have a digital camera to capture the life of men”., a small caravan of 3 elders and probably seven children passed by the size of procession never swelled till the grave yard. None of the faithful gave their ritualistic at least few steps together to the corpse and the bereaved. The oldest among them in his 60’s walked with the body wrapped in sparkling white coffin the two ends of which was tied giving the package a shape of bottle, in his lap. The body was that of a child but not of a baby.
One of the children walked behind holding a small polythene bag which showed a packet of incense stick a match box and some other stuff. In his left hand, with the other he held her sister’s hand firmly who seemed much younger to him.

Interestingly I found almost no lips muttering a prayer for the poor soul. A few days back a coffin bearing caravan had also passed that way then countless faces with down cast eyes had turned muttering prayers to bless the soul. Passer byes and shopkeepers and hawkers had lent their steps to earn the pleasure of Allah and honor the tradition of Prophet... It was a caravan of well-fed and well-clothed the size of which went on swelling till the procession reached the grave yard at the end of the road.

This was a patch of soiled men of clay. The next day when my bruised heart sought solace from another one, one of my Hindu friends said;” I is because of their previous bad karma because of which they are suffering. My Muslim friend said “it is the will of Allah the master of all affairs, a sin to think otherwise".

I was born in April. My mother delivered me at home in the small corner room over looking the busy road in a two story delapididated building, in a Muslim dominated locality in Kolkata the erstwhile British capital of India
It was a happy home, sweet home till I gained consciousness of immortal gloom that enveloped us and still stalks me from all side.
My father was not even able to bear school fees of Rs. 10/- because of big family consisting of 12 heads that included dependent aunt, and cousins.

I sat outside the office of principal, Aapa sat beside me. She had prepared me for the interview; I don’t remember the face of father. I remember hazily that he made me read from a colorful alphabet book. He talked to me English and probably asked simple questions. After coming out of the office, I narrated to Aapa what principal made me read and what questions he asked. Probably she was not happy with several of my answers.

My supervisor mam who was of dark complexion, young, middle height wore thick red lipstick on her lips and smelled with scent, would roam the lawns while children played, to see if any of us spoke in our native tongue। She always carried a wooden ruler. If any of the children, was found not speaking in english, she would impose a fine of six paisa. She would take the student to principal office to note down particulars. She was a dedicated supervisor with a remarkable memory.
She would keep a sharp eye on students: on our dress, manners, cleanliness and behaviors, inside the classroom and outside of it.

It was my cousin sister who got me admitted to Welland Gold Smith School, at Bow Street and helped me oft and on with expenses. I remember the first day in the school vividly. The assembly in the chapel was in full swing. I went running on the stage, interrupting the proceedings and told ma'm in my native language i/e Urdu: : "Main toilet jaaunga" She made me repeat twice or thrice: "May I go to toilet".
Then there was an uncle the proprietor of an optical shop. Everyday he would distribute chocolates to students who passed by his shop.
Our dress was blue pant and yellow shirt. Bhaijan: Aquil adopted son of my aunt or Haqqa chaccha, Osman bhai , a servant who was rather a family member, would fetch me from the school at 2pm.The school was in fact 10-15 minutes walk from my home.

One day Aquil bhai on way from school told me that they have bought kids at home. I was overjoyed and began to twist and jump with joy while walking along the sidewalk.

They were three kids, white, brown and the other a mixture of brown and white. The brown one survived. After one year or so it was stolen. The goat was tied to a lamppost below. I was quite attached with the goat and felt very sad for many days.


Boys could only study up to class 2 in the school so she got my school changed when I passed class I and got me admitted to Ling Liang English High School- at Phears Lane। It was a missionary school। It was the values I imbibed in my missionary Schools made me misfit in the present society I think, I am seeking and searching the same values everywhere।



There was and endemic problem to keep me in the school because of fees repeated default in payment of fees and accumulation, dress, shoes, books exercise books and of course my poor performance and bad hand writing and poor health because of malnutrition. Some of my teachers thought that I was suffering from some disease and would avoid close contact.
Nevertheless my neighbors and relatives thought that I was intelligent and good.
So at last I was taken out of Ling Liang school mid-way and admitted to an Urdu medium school. I loved my previous school inspite of all the trouble and worry and wept. But I never insisted my parents to let me there, because I felt pity on them.

Thought of home is painful

The thought of my native place brings nightmares and depression so much that my stomach churns breathing becomes shallow my limbs become numb.It is 12 years or more I have not been home do know who is there and who is not.I am the most coward man in the world. I don't want to hear any news either. Life was a tragedy. The sight of a letter from home made me catches my breath. There was always a bad news and request to do something for my sisters and help for other problems. I am the eldest of all my brothers and sisters. I have changed my address several times. My breast is loaded and heavy and breathing shallow as I write this message. 10/21/07 by shah
